Contingency Fees & Your Personal Injury Case

As explained, compensation for a car accident lawyer typically does not require a retainer or down payment. Your personal injury attorney will work on a contingency basis. They will accept the case and work on your behalf in exchange for a percentage of the proceeds if you win. Additionally, you may be obligated to pay certain costs associated with your case if you win. These expenses can include deposition fees, expert testimony or other related office fees and are deducted prior to the attorney fee.

The Florida Bar has established an attorney’s fee at 33 1/3 percent for any recovery up to $1 million if you settle your case prior to filing. If you win or settle your case after filing for a demand, the fee increases to 40 percent. This applies again to recoveries up to $1 million. If your case exceeds $1 million, additional fees may apply.
