If you’ve been in an accident caused by the negligence of another person, you may contact a Tampa personal injury attorney to review your case. That attorney will meet with you to assess your claim and determine if it has merit. If he or she decides to take your case, the next step will be to determine the attorney’s fee. In this video blog, Kinney, Fernandez & Boire attorney Marcus Fernandez helps answer one of the most common questions from accident victims: How does my attorney get paid?
Contingency Fees & Your Personal Injury Case
As explained, compensation for a car accident lawyer typically does not require a retainer or down payment. Your personal injury attorney will work on a contingency basis. They will accept the case and work on your behalf in exchange for a percentage of the proceeds if you win. Additionally, you may be obligated to pay certain costs associated with your case if you win. These expenses can include deposition fees, expert testimony or other related office fees and are deducted prior to the attorney fee.
The Florida Bar has established an attorney’s fee at 33 1/3 percent for any recovery up to $1 million if you settle your case prior to filing. If you win or settle your case after filing for a demand, the fee increases to 40 percent. This applies again to recoveries up to $1 million. If your case exceeds $1 million, additional fees may apply.
If you’ve been in an accident, take the first step and contact the experienced attorneys at Kinney, Fernandez & Boire today. They will provide a free consultation to review your case, and answer any questions you may have.
“How does your personal injury attorney get paid?” Vlog Transcript:
“One of the first questions I get asked during an initial consultation is how my fees get paid. Personal injury lawyers typically get paid on what’s called a contingency fee. We recuperate a percentage of the recovery that we make for our clients. Those fees are set by the Florida Bar. So whether you’ve been practicing for six months or 30 years those fees are typically set in stone. In addition to the fee agreement, we’d recuperate any costs that we spend in the furtherance of the client’s case. So if you have any questions or concerns regarding a legal matter please contact us at www.kfblaw.com. Thank you.”
