When Can a Lawyer Drop a Client?
A lawyer can drop a client under certain circumstances within the rules of professional conduct. However, one lawyer’s withdrawal doesn’t mean you’re out of options.
Under Florida’s Rule 1.16 and related model rules, an attorney may withdraw from representing a client if:
- The client fails to pay legal fees after a reasonable warning
- The working relationship has broken down or has been rendered unreasonably difficult
- The client insists on actions that violate ethics rules or the lawyer considers repugnant
- The lawyer’s physical or mental condition materially impairs their ability to represent
- Continuing representation would cause an unreasonable financial burden
- Or other good cause exists, such as the client refusing to cooperate
However, even in these cases, the withdrawing lawyer must:
- Give adequate notice
- Seek court approval in a trial court or appellate court if litigation is ongoing
- Take reasonable steps to avoid any material adverse effect on the client’s case
- Return any unearned fees, client files, and cooperate with a smooth transition to substitute counsel
